Minutes from the FOP meeting held February 3, 2004 Meeting Called to order at 1930 hrs by President Baab. Brother Shively gave the opening prayer. Pledge of Allegiance by all members led by Brother Daugherty. Roll Call of Lodge #104 Officers by Brother Bemis President Shawn Baab present Vice President Steve Gardner present Second Vice President Matt Snyder present Secretary Gerald Bemis present Treasurer Matt Poulton present Secretary’s Report Motion by Brother Bemis to accept the minutes as printed in the Informer. Second by many. No discussion. Motion passed. Treasure’s Report Motion by Brother Poulton to accept as read. Second by Brother M. Snyder. No discussion. Motion passed. Motion by Brother M. Snyder to retrieve OLC dues from the Deputies with two payroll deductions of $35.18 beginning in the last paycheck of February and ending with the first paycheck in March. Second by Brother Zurn. Short discussion. Motion passed. Legal/Labor Issues Arbitration: Gerald Barnes Arbitrator ruled in favor of the FOP clearly stating that he DID NOT violate any Sheriff’s Office policy and was reinstated to the rank of Transportation Officer. Michael Pizzo Discipline was reduced to a lower level due to the findings in Barnes ruling. Arbitration: Dave Concannon It is currently in the first stage in the Sixth District Court of Appeals. President Baab advised that we are currently in contract negotiations with management. The major issues of the contract are wage and insurance along with several other management concerns. These issues will be going to arbitration soon. Anyone wanting information on the status of the contract, please contact a member of the negotiation committee. There are still several pending grievances. ALL members of the Sheriff’s Office are encouraged to take an FOP representative with them to ALL Special Investigations interview whether you are the focus or a witness. All it takes is an incomplete answer whether a witness or a focus. You have rights! New Business First reading of the Constitution’s Amendments for FOP #104. Proposed a word Change "Conductor" to "Second Vice-President" and "Inner Guard" to "Sergeant at Arms." FIRST READING ARTICLE IX – DUTIES OF OFFICERS Section 5 Inner Guard Sergeant at Arms: The Sergeant at Arms shall keep an accurate record of the individual members attending each meeting, in a book provided for that purpose. The book shall be open for inspection by any Officer of the Lodge. He/she shall perform such additional duties as may be requested by the President. He/she shall assist the President in maintaining order at all meetings of the Lodge. He/she shall also be responsible for insuring that only Lodge members in GOOD STANDING are present at the regular and special meetings of the Lodge. He/she shall receive for his/her expense at least seventy-five (75) dollars per annum and have his/her TOTAL dues paid by the Lodge during the term of office. Section 6 Conductor Second Vice President: The Second Vice President shall assist the Secretary in taking minutes of all meetings of the Lodge and Executive Board. He/she shall assist all other Board members in the performance of their duties, at the direction of the President. He/she shall receive for his/her expense at least seventy-five dollars per annum and have his/her TOTAL dues paid by the Lodge during the term of office. ARTICLE XV – DUES Section 2 (paragraph 2) The total dues for an active social member of this Lodge are fifty-two (52) fifty-three (53) dollars per year. Motion by Brother Bemis to accept the amendments as read. Second by Brother Oliver. Discussion. Amendments must have three readings at a regular meeting before they can be adopted. Motion passed. Motion by Brother Poulton to "grandfather" the Court Deputies into FOP Lodge #104 due to being absorbed into the Deputy Sheriff classification. They will have automatic payroll deduction of $4.34 with no $53.00 due up front. Second by Brother Bemis. Discussion. Motion to table to the Executive Board by Brother Gardner. Second by Brother Combs. Motion passed. Old Business: Blood Drive Brother Baab and the membership thanked those who gave blood at the Deputy Miller/Officer Rasor Blood Drive. Fundraiser A "Thank You" letter will be sent out to those individuals and businesses that donated items/food to the Deputy Miller/Officer Rasor Fundraiser. Both officers are doing well and recovering. Chaplin’s Report Motion by Brother Shively to accept as read. Second by many. Discussion. Motion passed. Charitable Contributions Committee Motion by Brother Shively on behalf of Sgt. Osterfeld to donate $360 towards the "Eddie the Eagle" Elementary School Program. Second by many. Little discussion. Sheriff’s Office funds should pay for the Program. Motion Failed. Membership Craig M. Smith - Montgomery County Adult Probation Motion by Brother Bemis to accept the applicant as a member. Second by many. Motion passed. Social Committee Fish Fry volunteers will be meeting at the FOP Hall on March 12, 2004 at 0900 hrs for set up at Hara Arena. Those volunteers volunteering at the Fish Fry will meet at 1715 hrs for final assignment. Anyone interested in being on a Committee should contact one of the Executive Board members. PAC Committee FOP #104 is looking at possible endorsements in the upcoming political elections. For the Good of the Order Possible dues increase relayed by the Sate of Ohio FOP Board Meeting. More information will become available at the District 5 meeting in Greene County. District 5 FOP meeting will be held at Lodge #37, Greene County, on February 26, 2004 at 1900 hrs. Anyone wanting to attend should meet at the Lodge #104’s Hall at 1800 hrs. State Spring Board meeting will be held on April 16-17, 2004 in Independence, Ohio. Anyone wanting to attend please contact a member of the Executive Board.
