Legal/Labor Issues: Brother Bergman reported Brother Burghart was terminated and did not wish to fight his termination. Brother Burghart was contacted by the OLC after his termination and declined any further action be taken on his behalf. Brother Bergman reported there has been some conflict with Judge Heck who is a current judge at the Vandalia Municipal Court. Brother Bergman stated she has been taking no contest pleas at arraignments and then entering not guilty verdicts for defendants. Brother Bergman advised Major Landis and other members of management are going to sit down with the court personnel to discuss the issue. Brother Bergman also advised there has been talk with Greg Brush, the Clerk of Courts, about the possibility of Harrison Twp. sending all cases to Area Two Court. Brother Bergman stated it may not be possible due to the geographically boundaries being set. Brother Bergman advised if nothing is resolved then we may contact the OLC. Brother Bergman stated there are still concerns over the promotional process. Brother Bergman advised he has put out in several meetings the need for someone to chair a committee to look at the promotional process in order for anything to be done about the process. Brother Bergman stated the main issue is still the books that have been chosen to gather test questions from. Many of the test questions do not pertain to how the Sheriff’s Office works. Brother Bergman advised if anyone wants to chair the committee to look at the promotional process, let him know. Brother Bergman advised there have been GPS systems installed in many cruisers and they are active. The system only shows the current location of the cruiser. They are not capable of looking back to see where a cruiser was at a particular time. Brother Bergman reported he was told by Management and Tiburon there would be no recording and the GPS system is not web-based. The system is associated with CAD and cannot be accessed from home. Brother Bergman reported there was an issue about Brother Achtermann not being brought back sooner. Brother Bergman stated the Sheriff was concerned about the upcoming budget for 2010 and he was uncertain about any proposed layoffs. Brother Bergman advised the Sheriff did not want to bring back any deputies only to lay them off at the first of the year. Brother Bergman advised Management should know by November how 2010 will start because the budget is due very soon. The Chief Deputy advised that the Commissioners will not be cutting across the board this year like it has been done in the past.
